The suit claimed that:<\/strong><\/p>\n\n\n\n<p class=\"has-luminous-vivid-amber-color has-text-color has-link-color wp-elements-30736ddf3cac95536b7ac772ff93160f\"><strong><span style=\"color: var(--theme-palette-color-2, #55a630);\" class=\"stk-highlight\">1)<\/span> The county did not fulfill its obligations under the California Environmental Quality Act (CEQA) by approving permits for two homes and utility trenching based on a Mitigated Negative Declaration and not requiring an Environmental Impact Report, and<br><br><span style=\"color: var(--theme-palette-color-2, #55a630);\" class=\"stk-highlight\">2)<\/span> There was not adequate mitigation studied or implemented for the project, and<br><br><span style=\"color: var(--theme-palette-color-2, #55a630);\" class=\"stk-highlight\">3)<\/span> The county failed to consider the whole project and improperly segmented the required environmental review.<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center has-link-color wp-elements-5819f94c2e909466a6f4681ffc8cfca4\"><strong><a rel=\"noreferrer noopener\" href=\"https:\/\/wolfcreekarcheology.com\/files\/5-21-13proposedCEQAdecisionRattlesnakeIsland.pdf\" target=\"_blank\">Click here for court&#8217;s Proposed Statement of Decision.<\/a><\/strong><\/p>\n\n\n\n<div class=\"wp-block-stackable-divider stk-block-divider stk-block stk-ff9586e is-style-bar\" data-block-id=\"ff9586e\"><style>.stk-ff9586e hr.stk-block-divider__hr{background:var(--theme-palette-color-2,#55a630) !important;width:88% !important}<\/style><hr class=\"stk-block-divider__hr\"\/><\/div>\n\n\n\n<p class=\"has-text-align-center has-link-color wp-elements-64f96dcba48ea06176ad4c57db2182b7\"><strong><a href=\"https:\/\/wolfcreekarcheology.com\/files\/2013CEQACaseobjections.pdf\" data-type=\"URL\" data-id=\"wolfcreekarcheology.com\/files\/2013CEQACaseobjections.pdf\" target=\"_blank\" rel=\"noreferrer noopener\">Click here for Friends of Rattlesnake Island objections to the<br>proposed decision.<\/a><\/strong><\/p>\n\n\n\n<p class=\"has-palette-color-8-color has-text-color\"><strong>Friends made three attempts to obtain a temporary restraining order to stop construction until the case could be heard.  All were denied.  Meanwhile, though winter grading restrictions were in effect, the County Community Development Director granted the applicant an exemption, allowing grading on the island through the rainy season. <\/strong><\/p>\n\n\n\n<p class=\"has-palette-color-8-color has-text-color\"><strong>By the time the case was heard (a year later), all construction related excavation had been completed and any damage to archaeological resources had already taken place.<\/strong><\/p>\n\n\n\n<p class=\"has-text-align-center has-luminous-vivid-amber-color has-text-color\"><strong>Due to the fact that the damage had already been done, the court ruled that the Friends of Rattlesnake Island case against the county for CEQA violations was mute (no longer valid as there was no longer the possibility of preventing the damage that had already occurred to the cultural site)<\/strong><\/p>\n<\/div><\/div><\/div>\n<\/div><\/div>\n<\/div><\/div><\/div>\n<\/div><\/div>\n<\/div><\/div><\/div>\n<\/div><\/div>\n\n\n\n<p><\/p>\n","protected":false},"excerpt":{"rendered":"<p>RATTLESNAKE ISLAND COURT CASE February 2012, the Friends of Rattlesnake Island (Friends) filed a lawsuit against Lake County, the Board of Supervisors, and John Nady alleging violations of the California Environmental Quality Act.
